Membership Terms & Conditions

WITHOUT A PADEL LTD – CORBY
MEMBERSHIP TERMS & CONDITIONS

Last updated: October 2026

These Membership Terms & Conditions ("Terms") apply to all memberships purchased from Without A Padel Ltd ("Without A Padel", "we", "us" or "our"), including memberships purchased during any pre-sale period before the opening of the centre.

By purchasing a membership, you agree to these Terms together with any specific terms applicable to the membership package selected at the time of purchase.

1. About Your Membership
1.1 Membership provides access to the benefits associated with the particular membership package purchased, subject to these Terms, the availability of facilities and the applicable booking rules.
1.2 Membership does not guarantee availability of a particular court, time, facility, class, session or other service. All bookings remain subject to availability.
1.3 Membership benefits are personal to the named member unless expressly stated otherwise and may not be transferred, sold or assigned to another person.
1.4 A member must provide accurate and complete information when purchasing membership and must notify us of any material changes to their contact details.
1.5 Membership does not constitute ownership of, or any proprietary interest in, Without A Padel or any of its facilities.
1.6 Membership benefits are subject to reasonable operational, safety, capacity and availability requirements. We may introduce reasonable rules or restrictions where necessary to operate the centre fairly, safely and efficiently.
1.7 Unless expressly stated otherwise in these Terms or in the specific membership offer, membership does not guarantee any particular number of courts, classes, activities, opening hours or other facilities throughout the entire membership period.

Gold Monthly Membership is a continuing membership and is subject to recurring monthly payments.

3. Meaning of Peak and Off-Peak
3.1 Peak times include the entire weekend and any hour (or partial hour) from 1600 to close during weekdays.
3.2 Peak and off-peak periods may vary by day, time, season or other operational considerations.
3.3 We may reasonably alter peak and off-peak periods to reflect demand, operating requirements, events, promotions or other commercial considerations.
3.4 Any booking made using a membership discount will be subject to the peak/off-peak classification applicable at the time of booking.
3.5 Any change to peak or off-peak periods will not retrospectively alter the price or classification of a booking that has already been confirmed.

4. Court Discounts
4.1 Any percentage discount on court bookings applies only to the member's portion of the court cost.
4.2 For the avoidance of doubt, a membership discount does not provide a discount on the cost of the entire court where that cost is being shared between multiple players.
4.3 Where four players are sharing the cost equally, a member's applicable membership discount will be applied to that member's share only. The remaining players' shares will be charged at the applicable standard rate unless they have their own applicable discount.
4.4 Any court/session specifically described as free as part of a membership benefit applies to the full court/session, subject to availability and the applicable booking conditions.
4.5 Free court benefits therefore differ from percentage court discounts: a qualifying free court booking covers the applicable court/session rather than merely the member's individual share.
Coaching and Organised Activities
4.6 Membership court discounts apply to standard court-hire bookings only and do not apply to coaching sessions, lessons, clinics, courses, organised sessions, competitions, events or other activities unless expressly stated otherwise.
4.7 Where a coaching session, lesson or other organised activity includes exclusive or shared use of a padel court, the activity will not be treated as a standard court-hire booking for the purpose of applying a membership discount.
4.8 Where a coaching booking is charged as a combined price for coaching and court use, the membership court discount will not be applied to the combined price unless expressly stated at the time of booking.
4.9 Where we expressly identify a separate court-hire charge within a coaching booking as being eligible for a membership discount, the discount will apply only to that identified court-hire charge and not to the coaching or other activity fee.
4.10 Membership benefits do not entitle members to a discount on coaching or other organised activities provided by Without A Padel or by independent coaches operating at the centre, unless the applicable activity is specifically advertised as eligible for a membership discount.

5. Free Court Benefits
5.1 Free court sessions included with Diamond, Platinum and Gold memberships are subject to availability and must be booked through the applicable booking system or by any other method we specify.
5.2 Free court sessions are subject to the applicable off-peak restrictions.
5.3 Unused free court sessions expire at the end of the applicable membership period and cannot be carried forward, exchanged for cash or transferred to another person unless we expressly agree otherwise.
5.4 A free court booking may be subject to the same cancellation and no-show rules as a paid court booking.
5.5 Where a free court booking is cancelled after the applicable cancellation deadline or is not attended, the free court entitlement may be treated as used.
5.6 We may charge a reasonable cancellation or no-show fee for a free court booking where permitted by law and where the applicable charge has been clearly communicated before the booking is made.

6. Golf Simulator Benefits
6.1 Golf simulator sessions included within membership must be booked in advance and are subject to availability.
6.2 Unused golf simulator sessions expire at the end of the applicable membership period and cannot be carried forward or exchanged for cash.
6.3 Where the applicable membership allows a golf simulator session to be exchanged for a padel court discount, the exchange must be done in person at the centre.
6.4 The value or form of any alternative padel court discount will be communicated at the time the exchange is requested.
6.5 Golf simulator benefits are personal to the member and may not be transferred to another person unless we expressly agree otherwise.

7. Racket Rental
7.1 Free racket rental, where included in Diamond Membership, is subject to availability.
7.2 Free racket rental does not include responsibility for damage, loss or misuse of equipment.
7.3 We may require identification, a deposit or other reasonable security before equipment is issued.
7.4 We reserve the right to withdraw free racket rental from an individual member where equipment has been repeatedly lost, damaged or misused.

8. Bar, Pool and Other Discounts
8.1 Membership discounts apply only to products and services expressly included within the relevant membership package.
8.2 Discounts cannot normally be combined with another offer, promotion or discount unless expressly stated otherwise.
8.3 We may exclude particular products, events, packages or promotional offers from membership discounts where this is clearly communicated at the point of sale or before purchase.
8.4 Discounts are personal to the member and cannot ordinarily be transferred to guests or other players.
8.5 Membership discounts apply only to purchases made by the member and do not apply to purchases made by guests or other players.

9. Membership Pre-Sale
9.1 We may offer memberships for sale before the centre officially opens ("Pre-Sale Memberships").
9.2 A Pre-Sale Membership is a genuine membership purchase made in advance of the centre's opening and is subject to these Terms.
9.3 During the pre-sale period, the centre may not yet be operational and members will not be entitled to use the facilities until the applicable membership commencement date.
9.4 We currently anticipate opening the centre in December 2026 or January 2027. This is an anticipated opening period only and is not a guaranteed opening date.
9.5 The opening date may be delayed for reasons including planning, construction, building works, regulatory requirements, approvals, contractor delays or other circumstances outside our reasonable control.
9.6 Where an opening delay occurs, a membership purchased during the pre-sale will not lose membership time as a result of the delay. Unless otherwise agreed, the membership term will commence when the centre is able to commence providing the relevant membership benefits.
9.7 We will provide reasonable updates regarding any material change to the anticipated opening date.
9.8 Before a member purchases a Pre-Sale Membership, we will clearly communicate that the membership is being purchased before the centre has opened and that the anticipated opening date is not guaranteed.

10. Planning Permission and Failure to Open
10.1 The centre is subject to the necessary planning and other regulatory requirements.
10.2 If the required planning permission is refused and, as a result, we are unable to proceed with opening the centre, members who have purchased a pre-sale membership will be entitled to a full refund of the membership amount paid.
10.3 Any refund under this clause will be made to the original payment method wherever reasonably possible.
10.4 Where planning permission is granted but the opening is delayed, the provisions of clause 9 will apply.
10.5 We will not require a member to accept a substitute membership or alternative product in place of a refund where the centre cannot open as contemplated and the circumstances in clause 10.2 apply.
10.6 If the centre is unable to open for reasons other than refusal of planning permission, we will communicate the position to affected members and provide any remedy or refund required by applicable law or otherwise appropriate in the circumstances.

11. Membership Commencement
11.1 Annual memberships purchased during pre-sale will commence when the centre opens and the membership becomes capable of being used, unless a different commencement date is expressly stated at the time of purchase.
11.2 The 12-month period for a pre-sale annual membership will therefore not ordinarily run from the date of the original pre-sale payment.
11.3 Gold Monthly Membership purchased during pre-sale will not become subject to recurring monthly membership payments until the membership commencement date, unless the specific purchase terms clearly state otherwise.
11.4 We will communicate the commencement arrangements to members before memberships become active.
11.5 Once a membership has commenced, the membership term will continue in accordance with the applicable membership package even if the member does not use the facilities, except where suspension, cancellation, closure or another remedy applies under these Terms or applicable law.

12. Booking Privileges
12.1 Membership provides an advance-booking privilege as specified for the applicable membership package.
12.2 Diamond members may book up to 15 days in advance.
12.3 Platinum members may book up to 14 days in advance.
12.4 Gold members may book up to 10 days in advance.
12.5 Advance-booking privileges are subject to court availability and do not guarantee that courts will be available at any particular time.
12.6 We may reserve courts or other facilities for coaching, competitions, leagues, events, schools, corporate bookings, maintenance, private hire or other legitimate operational purposes.
12.7 Where reasonably practicable, significant changes affecting normal member access will be communicated in advance.
12.8 A member may make a maximum of 3 court bookings per day, regardless of membership type. This limit applies to bookings made for the member's own use or using the member's membership benefits.
12.9 We may apply different reasonable booking limits or restrictions to particular times, facilities, booking types or membership categories where necessary to ensure fair access and effective operation of the centre. Any such restriction will be communicated before it applies.

13. Booking System
13.1 We may use a third-party booking platform, including Playtomic, to administer court bookings and membership benefits.
13.2 Members may be required to create and maintain an account with the relevant booking platform.
13.3 Use of a third-party booking platform may also be subject to that provider's own terms and privacy policy.
13.4 We are not responsible for technical failures of third-party systems, although we will take reasonable steps to assist members where such failures affect their ability to use membership benefits.
13.5 Where a technical issue with the booking platform prevents a member from accessing an applicable membership benefit, we may provide a reasonable alternative booking method or other appropriate solution.

14. Cancellation and No-Shows
14.1 Members must comply with our current court cancellation and no-show rules as published on the Without A Padel website and applicable at the time of booking.
14.2 We may impose reasonable restrictions or charges on members who repeatedly book courts and fail to attend or repeatedly cancel at short notice, in accordance with the cancellation and no-show rules published on our website.
14.3 Where a free court is cancelled too late or is not attended, the free court entitlement may be treated as used.
14.4 We may introduce reasonable booking limits or restrictions to ensure fair access to courts for all members.
14.5 Our current booking, cancellation and no-show rules will be published on the Without A Padel website and may be updated where reasonably necessary. Members will be subject to the version of those rules applicable to the booking at the time it is made.

15. Membership Cancellation
15.1 Cancellation rights for membership will depend on the type of membership purchased and any applicable statutory consumer rights.
15.2 Annual memberships are generally purchased for a fixed 12-month period and are not cancellable simply because a member subsequently decides not to use the facilities, except where cancellation or a refund is required by law or expressly permitted under these Terms.
15.3 Diamond and Platinum memberships cannot be renewed.
15.4 Gold Annual Membership does not automatically renew unless expressly agreed.
15.5 Gold Monthly Membership may be cancelled by giving at least 30 days' notice. Cancellation will take effect at the end of the next monthly billing period following receipt of the cancellation notice. The monthly payment falling due during that notice period will remain payable in full, regardless of whether the member continues to use the membership during that period. No further payment will be taken after the cancellation has taken effect.
15.6 Cancellation does not ordinarily entitle a member to a refund for unused membership time unless required by law or expressly provided for under these Terms.
15.7 Requests to cancel a Gold Monthly Membership must be made by email to info@withoutapadel.co.uk.

16. Statutory Cancellation Rights
16.1 Nothing in these Terms affects any statutory rights that cannot lawfully be excluded or restricted.
16.2 Where membership is purchased online or by another means that gives rise to a statutory cancellation period, we will comply with applicable consumer legislation.
16.3 Where a member expressly requests that provision of services begins during a statutory cancellation period, any applicable statutory consequences of cancellation may apply.
16.4 Any statutory cancellation or cooling-off rights that apply to a membership are separate from the contractual cancellation provisions set out in these Terms.

17. Membership Payments
17.1 All membership prices will be clearly stated at the point of purchase.
17.2 Unless expressly stated otherwise, membership prices include VAT where VAT is legally applicable.
17.3 Annual membership fees must be paid in full at the time of purchase unless an alternative payment arrangement has been agreed.
17.4 Gold Monthly Membership payments will be collected on a recurring basis using the payment method authorised by the member.
17.5 Gold Monthly Membership costs £15 per month. Payments will be collected monthly in advance using the payment method authorised by the member, commencing on the membership commencement date and continuing until the membership is cancelled in accordance with these Terms.
17.6 If a recurring payment fails, we may suspend membership benefits until the outstanding amount has been paid.
17.7 We may charge reasonable costs associated with failed payments where permitted by law.
17.8 Where a third-party payment provider is used, payments may also be subject to that provider's applicable terms and privacy policy.

18. Changes to Membership Benefits
18.1 We may make reasonable changes to the operation of the centre and membership benefits where necessary for legitimate operational, safety, legal or commercial reasons.
18.2 We will not deliberately make changes that fundamentally alter the membership purchased without giving affected members appropriate notice and, where legally required, an appropriate remedy.
18.3 Membership discounts and benefits may be subject to reasonable operational rules, availability restrictions and exclusions.
18.4 Nothing in this clause permits us to remove rights or benefits where doing so would breach applicable consumer law.
18.5 Where we permanently remove a material facility or service that forms a significant part of a membership package, we will consider whether an appropriate remedy, adjustment or other action is required having regard to the circumstances and applicable law.

19. Centre Closure and Temporary Disruption
19.1 From time to time, parts of the centre may be unavailable due to maintenance, repairs, refurbishment, health and safety requirements, events or circumstances beyond our reasonable control.
19.2 Temporary closure or reduced availability does not automatically entitle a member to a refund where the disruption is reasonable and proportionate.
19.3 Where a prolonged closure materially prevents members from receiving the principal benefit of their membership, we will consider an appropriate remedy having regard to the circumstances and applicable law.
19.4 Where reasonably practicable, we will provide advance notice of planned closures or significant periods of reduced availability that are expected to materially affect members.

20. Member Conduct
20.1 Members must behave reasonably, respectfully and safely while using the centre.
20.2 Members must comply with:
centre rules;
health and safety requirements;
instructions from staff;
booking rules;
equipment rules; and
any reasonable requirements relating to the use of individual facilities.
20.3 We may suspend or terminate membership where a member:
behaves abusively, threateningly or aggressively towards staff or other customers;
deliberately damages property;
repeatedly breaches booking rules;
uses facilities improperly or dangerously;
engages in unlawful behaviour; or
otherwise commits a serious or repeated breach of these Terms.
20.4 Where appropriate, we will give the member an opportunity to address the issue before terminating membership.
20.5 Nothing in this clause limits any statutory rights of the member.

21. Guests and Other Players
21.1 Unless expressly stated otherwise, membership benefits apply only to the member.
21.2 A member may play with non-members where the applicable court booking and guest arrangements permit.
21.3 A member's membership discount applies only to the member's own portion of a shared court booking.
21.4 Members must not permit another person to use their membership account or membership benefits as if they were the member.

22. Children and Junior Players
22.1 Where children or juniors use the centre, they must comply with all applicable age restrictions, supervision requirements and facility-specific rules.
22.2 Parents or guardians remain responsible for children in their care except to the extent that responsibility is expressly assumed by Without A Padel.
22.3 Additional rules, consent requirements and safeguarding arrangements may apply to junior participation in particular activities or facilities.
22.4 Where required, parental or guardian consent must be provided before a junior participates in an activity or uses a facility.

23. Suspension or Termination by Without A Padel
23.1 We may suspend or terminate a membership where reasonably necessary because of serious misconduct, non-payment, fraud, misuse of membership benefits or a serious breach of these Terms.
23.2 Where membership is terminated because of a member's serious breach, the member may lose access to future membership benefits and may not be entitled to a refund except where required by law.
23.3 Where we terminate a membership for reasons unrelated to the member's breach, we will provide any refund or other remedy required by applicable law or reasonably appropriate in the circumstances.
23.4 Where reasonably practicable, we will communicate the reason for any suspension or termination to the member.

24. Health, Safety and Participation
24.1 Participation in padel, squash, golf simulator use, exercise classes and other physical activities at the centre is voluntary and involves inherent risks.
24.2 Members are responsible for considering whether they are fit and able to participate safely. Where appropriate, members should seek medical or other professional advice before participating in physical activities.
24.3 Members must follow all reasonable health and safety instructions, including instructions relating to warm-up, equipment, footwear, court use and the safe use of facilities.
24.4 Members should inform a member of staff of any relevant injury, illness, medical condition or other circumstance where doing so is reasonably necessary to enable the activity or facility to be used safely.
24.5 We may reasonably restrict or refuse participation in an activity or use of a facility where we have a reasonable safety concern.
24.6 Nothing in this section excludes or limits any liability or legal responsibility that cannot lawfully be excluded or limited.

25. Liability
25.1 Members use the centre and its facilities at their own risk, subject to our obligations under applicable law.
25.2 Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
25.3 Members are responsible for taking reasonable care of their own property.
25.4 Members may be responsible for loss or damage caused by their deliberate or negligent actions.

26. Personal Information
26.1 We will process member information in accordance with our Privacy Policy and applicable data protection legislation.
26.2 We may use member information to administer memberships, process payments, manage bookings, communicate with members and provide membership benefits.
26.3 Where third-party booking or payment platforms are used, information may also be processed by those providers in accordance with their own privacy policies.
26.4 Our Privacy Policy explains how we collect, use, store and share personal information and the rights available to individuals in relation to their personal information.

27. Promotions and Special Offers
27.1 Unless expressly stated otherwise, membership discounts cannot be combined with other promotional offers.
27.2 Promotional offers may be subject to separate terms and conditions.
27.3 We reserve the right to withdraw or amend promotional offers where reasonably necessary, subject to any rights already acquired by customers who have purchased them.
27.4 Nothing in this clause affects any rights a customer has already acquired in relation to a promotion or offer.

28. Diamond and Platinum Limited Memberships
28.1 Diamond and Platinum memberships are limited-edition membership products.
28.2 The stated membership limits are:
Diamond: 75 memberships.
Platinum: 150 memberships.
28.3 Once the relevant allocation has been sold, no further memberships of that type will be offered.
28.4 Neither Diamond nor Platinum membership will be renewed or reintroduced after the relevant membership period has ended.
28.5 The fact that a member has purchased a Diamond or Platinum membership does not give that member any right to purchase another Diamond or Platinum membership in the future.

29. Gold Membership Availability
29.1 Gold Membership is the standard membership offering and is intended to remain available on an ongoing basis.
29.2 We may nevertheless change, suspend or withdraw the sale of new Gold Memberships where reasonably necessary for operational or commercial reasons.
29.3 Any such decision will not affect existing membership rights during a member's current membership period except as permitted under these Terms and applicable law.

30. Changes to These Terms
30.1 We may update these Terms where reasonably necessary.
30.2 The version of the Terms applicable to a member will generally be the version in force when the relevant membership was purchased, subject to any subsequent changes that are required by law or are reasonably necessary for the operation of the membership.
30.3 Where a change materially and adversely affects an existing member, we will provide reasonable notice where practicable.
30.4 We will not use a change to these Terms to remove or retrospectively alter rights that a member has already acquired where doing so would be unlawful.

31. Complaints
31.1 We aim to provide a high standard of service.
31.2 Any complaint should initially be raised with a member of the Without A Padel management team.
31.3 We will consider complaints fairly and aim to resolve them promptly.
31.4 Nothing in this complaints procedure prevents a member from exercising any statutory or other legal rights available to them.

32. General
32.1 If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as removed or modified to the minimum extent necessary, and the remaining provisions will continue to apply.
32.2 A failure or delay by us to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision later.
32.3 These Terms, together with the specific membership information and other contractual information provided to the member at the point of purchase, form the agreement between the member and Without A Padel concerning the membership.
32.4 If there is a conflict between these Terms and a specific written promise made in the membership offer at the point of purchase, the specific membership offer will prevail to the extent of the conflict.
32.5 Nothing in these Terms is intended to exclude or restrict any mandatory statutory right or protection that applies to the member.

Governing Law
32.6 These Terms are governed by the laws of England and Wales.
32.7 The courts of England and Wales will have jurisdiction in relation to disputes arising from these Terms, subject to any mandatory rights a consumer may have under applicable law.

Important: Percentage court discounts apply only to the member's individual share of the court cost. A free court entitlement covers the full court/session.
